MedRecall+ Terms of Service
These Terms of Service (“Terms”) are an agreement between you and VezaMed, an independent developer in North Carolina (“we” and “us”), about your use of MedRecall+ (“the App”). By downloading or using the App, you agree to these Terms. Our Privacy Policy explains how your information is handled, and these Terms should be read together with it. If these Terms and the Privacy Policy ever differ about your information, the Privacy Policy controls.
1. What the App is
MedRecall+ is a personal health record app for iPhone, currently offered in the United States. It helps you gather your own health information into one place on your phone, including records from hospitals and clinics that use Epic, Apple Health data, and information you enter yourself such as doctors, medications, conditions, appointments, visit notes and voice recordings. We plan to add a Medicare connection in a future version, as described in the Privacy Policy.
2. Who may use it
You must be at least 18 years old. The App is for your own personal, non-commercial use, to access your own health information. If you connect an account on behalf of another person, you confirm that you have that person's permission or the legal authority to do so, for example as a caregiver or legal representative.
3. Your account and sign-ins
The App has no account with us. You are responsible for the security of your iPhone and for keeping your sign-in details for connected services, such as a hospital portal, Google or Microsoft, private. You are responsible for the accuracy of the information you enter.
4. Not medical advice
The App is an organizing tool. It does not give medical advice, diagnosis or treatment, and it does not check medicines for interactions. Do not use it in place of a doctor's judgment. Always ask a qualified health professional about your health, your medicines and your records. In an emergency, call 911 or your local emergency number.
5. Your records may be incomplete or wrong
The App shows information that comes from you and from other organizations. That information can be late, incomplete, withheld, duplicated or wrong, and the App's summaries are only as good as what it is given. Check anything important with your care team.
6. Recording visits
The App can record and transcribe conversations. Laws about recording differ by place, and some require everyone in the conversation to agree. You are responsible for knowing the rules where you are and for getting any consent that is needed before you record. The App does not get anyone's consent for you. When you first open the App, it shows a Recording & Consent notice. When you tap “I Understand,” the App saves a record of that on your phone (the date and time, and the version of the notice you saw). You can see it in Settings, and Delete All Data removes it. Recordings and transcripts are saved on your phone unless you choose to save them elsewhere.
7. Backups and your data
Backing up is your choice and your responsibility. Backup files go to your own Google Drive, OneDrive or Files, and we cannot see, restore or delete them for you. Keep your own copies of anything you cannot afford to lose. If you delete the App or reset your phone, information that was not backed up may be lost.
8. Acceptable use
You agree not to: (a) access or try to access information you are not allowed to access; (b) interfere with the App's security or with any connected service; (c) copy, reverse engineer or resell the App, except where the law allows; or (d) use the App for anything unlawful.
9. Third-party services
The App connects to other services at your direction, including hospital and health-system portals that use Epic, Apple Health, Calendar and Reminders, Google (Sign-In and Drive), Microsoft (Sign-In and OneDrive), and Files. Each service has its own terms and privacy practices, and we encourage you to read them. We do not control those services and are not responsible for them.
MedRecall+ is made by an independent developer. It is not affiliated with, endorsed by, or sponsored by CMS, Medicare, Medicare.gov, the U.S. Department of Health and Human Services, Epic Systems Corporation, Apple Inc., Google LLC or Microsoft Corporation. Their names are used only to say where your information comes from.
Medicare (future version). When the Medicare connection is available, it will use the CMS Blue Button API. This product uses the Blue Button APIs but is not endorsed or certified by the Centers for Medicare & Medicaid Services or the U.S. Department of Health and Human Services. We will never ask for your Medicare.gov username or password, and we will not disclose your Medicare information to anyone without your clear permission.
10. Availability and changes to the App
The App is provided “as is” and “as available.” We do not promise it will always work or be free of errors. We may change, pause or stop features, including if a connected service changes or becomes unavailable.
11. No warranties
To the fullest extent the law allows, we make no warranties of any kind about the App, whether stated or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Limit of liability
To the fullest extent the law allows, VezaMed is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, arising from your use of the App. Some places do not allow these limits, so they may not apply to you.
13. Ending your use
You can stop using the App and delete it at any time. We may suspend or end your use of the App if we believe you have broken these Terms.
14. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules.
15. Changes to these Terms
If we change these Terms in a way that affects your rights or how your information is used, we will tell you before the change takes effect, with a notice in the App, on our website and in the App Store update notes. The notice will say what changed. If you do not agree, you can stop using the App and delete your information. The date at the top shows the latest version.
